Terms of Service

These Terms of Service ("Terms") govern your access to and use of AutoRetry, Inc.'s services. By creating an account or using AutoRetry, you agree to these Terms.

Last updated: August 18, 2026 · Effective: August 18, 2026

1. The Service

AutoRetry is an automated payment recovery service. It connects to your Stripe account, detects failed payments, and sends branded recovery email campaigns to your subscribers on your behalf.

AutoRetry is a data processor. You (the account holder) are the data controller of your subscribers' information. You instruct AutoRetry on what campaigns to run; AutoRetry executes them on your behalf. See our Data Processing Agreement for full details.

2. Account Registration

  • You must provide accurate, complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of your business.
  • One account per business entity. Team members may be added when multi-user support launches.

3. Pricing and Payment

AutoRetry charges a flat monthly or annual subscription fee based on your plan tier. We do not charge a percentage of recovered revenue. The amount you recover is 100% yours.

Current pricing plans:

  • Starter: $19/month ($15/month billed annually) — up to $15k/mo MRR
  • Pro: $49/month ($39/month billed annually) — up to $100k/mo MRR
  • Growth: $129/month ($99/month billed annually) — unlimited MRR

Pricing is subject to change with 30 days written notice. You may cancel at any time; no refunds are issued for partial billing periods unless required by applicable law.

4. Acceptable Use

You agree not to use AutoRetry to:

  • Send unsolicited commercial email (spam) to addresses not previously in a legitimate billing relationship with you.
  • Send recovery emails for fraudulent or unauthorized charges.
  • Violate any applicable law including CAN-SPAM, GDPR, CASL, or any other anti-spam or data protection regulation.
  • Circumvent, disable, or interfere with security-related features of AutoRetry.
  • Reverse-engineer, copy, or create derivative works from the AutoRetry software.

5. Data Ownership

You own your data. All subscriber data, campaign content, email templates, and recovery records belong to you. AutoRetry does not claim ownership of any data you provide or that is generated on your behalf.

You grant AutoRetry a limited, non-exclusive license to process your data solely to provide the service. This license terminates when you close your account or delete the relevant data.

6. Service Availability

AutoRetry aims for high availability but does not guarantee 100% uptime. Scheduled maintenance, third-party outages (Stripe, Vercel, Resend), and force majeure events may cause interruptions. We will communicate planned maintenance in advance where possible.

7. Limitation of Liability

AutoRetry is provided "as is." To the maximum extent permitted by applicable law, AutoRetry, Inc. shall not be liable for:

  • Lost revenue, missed recovery events, or failed email deliveries.
  • Indirect, incidental, special, or consequential damages.
  • Actions taken by Stripe, Resend, or other third-party services.

Our total aggregate liability is limited to the amount you paid AutoRetry in the 3 months preceding the claim.

8. Termination

You may cancel your account at any time from the Settings → Billing page. Upon cancellation, your data will be retained for 30 days to allow export, then permanently deleted.

AutoRetry may suspend or terminate accounts that violate these Terms, with notice where practicable.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For EU/UK customers, mandatory local consumer protection laws apply and take precedence where they conflict with these Terms.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to your registered address at least 30 days before taking effect. Continued use of AutoRetry after the effective date constitutes acceptance.
